General terms and conditions - Flachau voucher

1 Scope of application
These general terms and conditions apply to the purchase, use and redemption of vouchers from the Flachau voucher system, issued by Flachau Tourismus. They govern both the purchase in the webshop and in the Flachau Tourist Office as well as the redemption at all participating partner businesses within the system.

2. Operator & contractual partner
The operator of the voucher system is Flachau Tourismus (Flachau Tourist Office).
When a voucher is purchased a contractual relationship arises between the purchaser and Flachau Tourismus.
On redemption the contractual relationship arises directly between the voucher holder and the redeeming partner business. In this case Flachau Tourismus is merely the operator of the billing system.

3. Voucher types
The following voucher types can be offered:
- Value vouchers (multi-purpose vouchers), redeemable at all participating partner businesses.
The respective redeemability is indicated with the product and on the voucher.

4. Purchase process & payment modalities
Vouchers can be purchased online via the webshop or on site at Flachau Tourismus.
The voucher only becomes valid after full payment has been received.
If purchased online, the voucher is provided as a PDF.
Postal delivery - if offered - may incur additional charges.

5. Period of validity & limitation period
Unless otherwise stated, the validity period is 3 years from the end of the year in which the voucher was purchased.
After this period, the voucher can no longer be redeemed.
Residual values remain valid until the end of the validity period.

6. Redemption
- Vouchers can be redeemed as a means of payment in the Flachau Tourismus webshop, at defined partner businesses via the webshop or at local partners.
- Partial redemption is possible. Unused amounts remain valid until the expiry date.
- Cash payment is excluded, unless required by law.
- Redemption is only valid if the voucher number is clearly legible and has not been tampered with.

7 Loss & misuse
Flachau Tourismus accepts no liability for loss, theft or unauthorised use.
Vouchers can be cancelled if misuse is suspected.
Manipulated or duplicated vouchers do not authorise redemption.

8. Right of cancellation
When purchasing online, consumers have a 14-day right of cancellation, provided the voucher has not already been (partially) redeemed or fully personalised.
The cancellation must be made in writing to Flachau Tourismus.
In the event of cancellation, the purchase amount will be refunded to the original means of payment used.

9. Settlement with partner businesses
Flachau Tourismus carries out the settlement of the redeemed vouchers with the partner businesses.
A service or system fee as well as a commission can be withheld from the amount paid out.
There are no additional costs for customers as a result of this process.

10. Sales tax
As the vouchers from Flachau Tourismus are value or multi-purpose vouchers, the taxable turnover only arises when the voucher is redeemed.

11 Liability
Flachau Tourismus is not liable for service disruptions or damages caused by the partner company.
Flachau Tourismus is only liable for system-related failures or technical problems in the event of gross negligence or wilful intent.

12. Data protection
Personal data will only be processed for the purpose of processing the voucher purchase, creating the voucher and - if necessary - for redemption and invoicing.
Data will only be passed on to partner businesses if necessary for the redemption.
The privacy policy of Flachau Tourismus applies.

13. Changes to the conditions
Flachau Tourismus reserves the right to change these terms and conditions at any time. For vouchers already purchased, the conditions valid at the time of purchase apply.

14 Applicable law & place of jurisdiction
The place of jurisdiction for all disputes arising directly between the guest and Flachau Tourismus is agreed to be the Austrian court with local and subject-matter jurisdiction for the registered office of Flachau Tourismus. Furthermore, Austrian law shall apply exclusively.

15. Severability clause
If parts or individual formulations of this text do not, no longer or do not completely correspond to the current legal situation, the remaining parts of the document remain unaffected in their content and validity.
