General Terms and Conditions - Flachau Tourismus

1. scope of application:
These General Terms and Conditions apply to all bookings made via Flachau Tourismus, available at the domain flachau.com, as well as those made in any other way (by post, email, fax or telephone) with Flachau Tourismus as agent or organiser.

2. contractual relationship between Flachau Tourismus and the guest:
Flachau Tourismus as agent:
Flachau Tourismus offers the guest the opportunity to book third-party travel services. In this context Flachau Tourismus does not offer any travel services on its own responsibility and accepts no liability in this respect. Through the booking only an agency contract is concluded between the guest and Flachau Tourismus, to which the provisions of § 31b ff KSchG do not apply. Flachau Tourismus therefore does not owe the guest a (travel) service as part of its mediation, nor does it guarantee fulfilment of the contract by the accommodation provider.
Flachau Tourismus as an organiser: Flachau Tourismus only offers packages as an organiser in exceptional cases, which are expressly indicated in the relevant announcements (clearly marked in the offer text as offers from Flachau Tourismus).

3. booking
Booking for organised services:
In the case of arranged services, reservations are passed on to the relevant accommodation provider via Flachau Tourismus as the agent on behalf of the guest. The mediation by Flachau Tourismus is free of charge for the guest.
Flachau Tourismus as organiser:
For travel offers (packages) which are provided by Flachau Tourismus as the organiser (and are clearly marked in the offer text as offers from Flachau Tourismus), the guest makes their reservation/booking directly with Flachau Tourismus.

4 Conclusion of the contract
With the reservation the guest makes an offer to the accommodation provider (in the case of arranged services) or Flachau Tourismus (in the case of packages, whereby this is expressly stated in the text of the offer) to conclude a contract. The contract is concluded through confirmation by Flachau Tourismus. If Flachau Tourismus itself acts as organiser, the contractual relationship arises between Flachau Tourismus and the guest. In this respect the provisions of these GTC and the terms and conditions for the hotel industry (as amended) apply.

5. payment
As soon as the contract has been confirmed by Flachau Tourismus, the following payment conditions apply.
Payment for mediated contracts:
The accommodation provider has the right to demand a deposit as security. If he makes use of this right, a corresponding note can be found in the offer and/or in the booking. The paying agent for this deposit is the accommodation provider. The remaining holiday price, as well as any additional costs incurred (final cleaning, local tax, electricity, etc.) are to be paid by the guest directly to the accommodation provider. If a credit card number is provided at the time of booking, the accommodation provider can use this in the event of cancellation and debit the amount due. Flachau Tourismus is not responsible for the (contractual) content (e.g. cancellation fees etc.) of the individual accommodation providers and distances itself from any liability in this regard. The accommodation provider alone is responsible for the correctness and up-to-dateness of the information and the availability of the rooms.
Payment of package offers from Flachau Tourismus as organiser:
If Flachau Tourismus acts as an organiser in its own name (especially package deals) the travel price or deposit is as previously shown in the offer, as stated on the booking confirmation.

6 Notifications from the guest
Notifications by the guest regarding changes and cancellations can be made to Flachau Tourismus or the accommodation provider both for arranged services and for services offered by Flachau Tourismus itself. The accommodation providers in Flachau have their own cancellation conditions. For Flachau Tourismus as the organiser, the respective cancellation conditions and general terms and conditions apply, which are stated in writing on the offer or on the booking confirmation.

7 Hotel categories and hotel information
Hotel classification The hotel classification is based on an inspection of the accommodation by the Austrian Hotel Association of the Austrian Federal Economic Chamber.
Additional hotel information: The additional hotel information is based on the hotel's own information. Flachau Tourismus accepts no liability for this information in the case of arranged holidays.

8. data protection
The guest acknowledges that the data entered by him will be processed electronically. They will only be passed on insofar as this is necessary for the realisation of the booking. It will not be passed on for other purposes. Flachau Tourismus complies with the statutory data protection regulations. At this point we would like to refer you to our current data protection regulations.

9 General information
Unless expressly agreed otherwise, the General Terms and Conditions for the Hotel Industry apply to all bookings (see above). The place of jurisdiction for all disputes arising directly between the guest and Flachau Tourismus is agreed to be the Austrian court with local and subject-matter jurisdiction for the registered office of Flachau Tourismus. Furthermore, Austrian law shall apply exclusively.

10. severability clause
If parts or individual formulations of this text do not, no longer or do not completely correspond to the current legal situation, the remaining parts of the document remain unaffected in their content and validity.
